In its ruling – which has finally been delivered – the European Court is very clear: drivers may not spend their normal weekly rest periods in the vehicle. This means that some member states that already interpreted Regulation 561/2006 in this sense, such as Belgium, France and Germany, will be vindicated. Some member states that have not yet banned ‘cab camping’ pending the ruling are likely to do so soon. The Netherlands is likely to be the first: many foreign drivers drive there from Belgium and Germany specifically to take their long weekend rest in the cab, causing a nuisance.
