Notice: limitation of liability ‘Trevor’ collision Buda Bridge

LIMITATION OF LIABILITY OF Barge (m.t.s. ‘Trivor’)

pursuant to art. 642a Rv. et seq. in conjunction with art. 8:1060 BW et seq. and art. 1 CLNI 2012 et seq.

in the case of:

1. the private company with limited liability MOUNTAIN TANKERS B.V.established at Zwijndrecht (NL), and
2. the European public limited liability company ALLIANZ GLOBAL CORPORATE & SPECIALTY SE, established in Munich, Germany, applicants,

the following is brought to the attention of interested parties:

1. By order of the Rotterdam District Court dated 3 April 2023, the amount to which the applicants’ liability is limited for the time being was, inter alia, set at SDR 1,545,189.40, with an order to set fund, as specified therein. The aforesaid court also appointed a bankruptcy judge and appointed the undersigned as liquidator.

2. On 25 April 2023, the Rotterdam District Court declared that the applicants had complied with said order.

3. By order dated 2 May 2023, the supervisory judge ruled that the claims against the applicants, as well as the challenges to the reliance on limitation of liability, should be settled no later than Friday 18 August 2023 must be lodged with the liquidator Mr A.J. van Steenderen (Van Steenderen Mainport Lawyers B.V.), Zeemansstraat 13, 3016 CN Rotterdam, the Netherlands,

and further determined:

4. That on Friday 13 October 2023 at 09.00 hours in the building of the Rotterdam District Court, Wilhelminaplein 100-125 in Rotterdam, verification of the claims submitted or hearing of challenges to the invocation of limitation of liability will take place

5. and that the liquidator will announce this decision as soon as possible in

• the newsletter and on the website of the Dutch magazine Schuttevaer (www.schuttevaer.nl); and
• in the newsletter and on the website of shipping website Flows(flows.be).
